Why did the police back off in Portland?
Because a federal judge issued a restraining order against local police
What were the federal tactics?
Tear gas, rubber bullets, use of unidentified federal agents, use of unmarked federal vehicles, & detention without probable cause
How did this cause tensions over federalism?
It became an issue of state v federal jurisdictions
The Governor and both State Senators asked the federal troops to withdraw
State and local officials did NOT ask for federal assistance
What were the issues of state vs federal jurisdiction?
The federal government does not have routine authority to enforce state law
What justification did the President use and which one should he have used?
The official justification was the protection of federal property specifically the federal courthouse. However, the President should have used the ‘Insurrection Act of 1807’ which meant the President can deploy federal forces in the event of obstruction of US state or federal law
