5 Characteristics of an Effective Law Flashcards
Chapter 3.3
What are the 5 Characteristics of an Effective Law?
Reflects society’s values, is enforceable, is known, is stable, is clear and understood
Explain - Reflects Society’s Values
Laws will keep changing to keep up with society’s different values. If the laws are not in sync with society’s values, people won’t be inclined to follow them
Explain - Is Enforceable
Laws should be enforceable otherwise people will disobey the law as there is no punishment. Public areas and physical behaviours are easier to monitor.
Explain - Is Known
It is the responsibility of an individual to research the relevnt laws when making an important decision. But it is also the duty of legal bodies to inform the public of changes to the law. When laws are unknown, people will be oblivious to the fact they are breaking a law.
Explain - Is Stable
Laws shouldn’t be too dynamic because it will then be hard to keep track of the relevant law for an issue.
Explain - Is Clear and Understood
Laws should be consistent and precise to ensure eveyrone can understand what they mean. If people do not understand a law, they will disregard it.
