A

Definition of Development

Limb (1) - the carrying out of any building / engineering / mining / earthworks / or other operations in, on, over, under
Physical altercation of the land
Some degree of permanence to the land itself
Limb (2) - Any Material Change In Use of any building or land
Activities which are done in, alongside, or on the land but do not interfere witht he actual physical characteristics of the land
This refers to the regulation by Groups Table (18 Classes)
Any Uses that do not fall under these 18 Use Classes are considered as “Unclassified” Use

The Planning Act No.3 Section 3 (2)

A

Operations Not Requiring Permission (Not deemed to involve development)

(a) works for maintenance, improvement, or other alteration of a building which do not materially affect the external appearance or the floor area of the building
Eg. Replacement or changing of windows and doors okay
Eg. Perimeter Fence, Boundary Wall, other enclosure not exceedings 1.8m okay
Eg. Site Layout reduction in overall size of approved buildings which are under construction okay
Eg. Interior of Building false ceiling or aircon works okay
(b) minor preliminary works and such temporary use of land - BUT NOT FOR NATIONAL MONUMENTS / CONSERVATION BUILDINGS / Located within conservation areas, envelop control areas, central areas, urban design areas, street block plan areas or other planning study areas where specific guidelines must adhered to
Eg. temporary sheds, scaffoldings, trade fair, funfair, carnival, athletics or sports meet, bazaar okay
HENCE, Approval is Required for:
From one use class to another use class
One use class to an unclassified use or vice versa
Between two unclassified uses

Outline Permission, Provisional Permission

A

Outline Permission
- Broad Proposal allowing you to test out proposed land use, plot ratio, or building height of a property before deciding if you want to proceed with a formal application
- Early consultation to seek URAs input on broad matters relating to land use, intensity, type, form, and height
- Valid for 6 months
- Does not allow any advance development or works to be carried out

Provisional Permission
Provisional permission is the approval by the competent authority under section 17 of the Planning Act (Cap. 232)
May be granted first to authorise the carrying out of specified preliminary works such as piling and foundation (fast track)
Valid for 6 months or longer if required
When all the PP conditions have been complied with, the written permission will be issued
