Assault
- simple = intentional placing of another in reasonable apprehension of receiving a battery
- Aggravated = assault committed with a dangerous weapon
- aggravated assault with a firearm = simple assault + firearm
False Imprisonment
unlawful intentional confinement or detention of another
FI with a DW = while the offender is armed with a dangerous weapon
Aggravated Burglary
the unauthorized entering of any structure where a person is present with the intent to commit a felony or theft therein, when the offender:
- is armed with a dangerous weapon,
- arms himself with a dangerous weapon after entering, or
- commits a battery on another during the burglary
second degree = battery committed with a dangerous weapon when the offender intentionally inflicts serious bodily injury
Criminal Damage to Property
intentional damaging of property of another without consent
by means other than fire or explosion
aggravated = foreseeable that human life might be endangered
Criminal Trespass
the entry or “remaining upon” immovable property owned by another without express, legal, or implied authorization
Theft
misappropriation or taking of anything of value which belongs to another
without consent
and with the intent to permanently deprive
attempted theft = card declined?
Felon with a Firearm
It is unlawful for a person who has been convicted of a felony crime of violence or a felony drug possession crime to possess a firearm.
Illegally Supplying a Felon with a Firearm
the intentional giving, selling, donating, providing, lending, delivering, or otherwise transferring a firearm to any person known by the offender to be a person convicted of a felony and prohibited from possessing a firearm
Computer Tampering
The intentional accessing or assisting someone else in accessing data in a computer or computer program without authorization from the owner of the computer.
Stalking
the intentional and repeated harassing of another person in a manner that would cause a reasonable person to feel alarmed or to suffer emotional distress
includes distress caused by threats of death or bodily injury
Criminal Conspiracy
the agreement or combination of two or more persons for the specific purpose of committing any crime
at least one party must do an overt act in furtherance of the object of the agreement or combination
Obstruction of Justice
tampering with evidence with the specific intent of distorting the results of any criminal investigation or proceeding which may reasonably prove relevant to a criminal investigation or proceeding
committed with the knowledge that such act has, reasonably may, or will affect an actual or potential present, past, or future criminal proceeding

Flight from an Officer
the intentional refusal of a driver to bring a vehicle to a stop knowing that he has been given a visual and audible signal to stop by a police officer when the officer has reasonable grounds to believe that the driver has committed an offense

Reckless Operation of a Vehicle
the operation of any motor vehicle, aircraft, vessel, or other means of conveyance in a criminally negligent or reckless manner
eg: high speed chase/ ramming police car/ driving erratically and almost hitting peds/ running red light/ lethal accident involvement
Hit-and-Run Driving
intentional failure of the driver of a vehicle involved in or causing any accident,
to stop such vehicle at the scene of the accident,
to give his identity,
and to render reasonable aid
Possession of CDS / with Intent to Distribute
It is unlawful for any person to knowingly or intentionally possess a controlled dangerous substance classified in any schedule of unlawful drugs
+ possession of a controlled dangerous substance with intent to distribute
Driving while Intoxicated
the operating of any motor vehicle, aircraft, watercraft, vessel, or other means of conveyance when: the operator is under the influence of alcoholic beverages/ any controlled dangerous substance
Battery
the intentional use of force or violence on the person of another
- second degree = committed when the offender intentionally inflicts serious bodily injury
- aggravated = with dangerous weapon
includes the intentional administration of a poison or other noxious liquid or substance to another
Dangerous Weapon
An instrumentality that, in the manner used, is calculated or likely to produce death or great bodily harm
(ie hitting very hard with a nightstick)
Self Defense
a person may use self-defense if he reasonably believes that his conduct is necessary under the circumstances.
When you CANNOT claim self defense
A person who is an aggressor or who brings on a difficulty CANNOT claim the right to self-defense
UNLESS
he withdraws from the conflict in good faith and in such a manner that his adversary knows or should know that he desires to withdraw and discontinue the conflict
