2.3 Flashcards
4 different types of imprisonment
- life sentences
- indeterminate sentences
- determinate sentences
- suspended sentences
What is a life sentence
judge sets a minimum time the offender must spend in prison before considered to be released
What is an indeterminate sentence
Judge sets a minimum amount of time the offender must serve in prison and will be released after served
What is a Determinate sentence
offenders will be given a minimum sentence and if good behaviour will be released halfway through - most prisoners serve this
What is a suspended sentence
the offender does not go to prison but if commits another crime they will serve both the original sentence and the other crime they have committed
advantage of how imprisonment meets the aims of punishment
- life sentences prevent reoffending and protect society
the disadvantage of how imprisonment meets the aims of punishment
the rates of crimes are increasing by re-offenders showing prisons aren’t rehabilitating individuals
Advantage of how community sentences meet the aims of punishment
9% more effective at reducing re-offending rates compared to imprisonment
A disadvantage of how community sentences meet the aims of punishment
3/4 of offenders who were serving a sentence had previously had a community sentence which suggests it doesn’t always act as a deterrent to not commit further activity
Advantage of how fines meet the aims of punishment
Provides deterrence and punishment for the offender to not commit further crimes
A disadvantage of how fines meet the aims of punishment
61% of fines are written off as offenders can not be traced
What is a conditional discharge and how is it an advantage of meeting the aims of punishment
minor charges are given for minor offences to stop re-offending/deterrence
What is an absolute discharge and how is it an advantage of meeting the aims of punishment
no sentence is given as judge believes court was enough deterrence to ensure no further crimes are committed
disadvantages of how discharges don’t meet the aims of punishment
Those who don’t respect the system are likely to re-offend which is putting society at harm
