What is an improvement notice?
Improvement notices are issued when an inspector believes that legislation is being contravened or about to be broken.
Breached legislation must be identified, and the improvements must be made within the specified time period.
Notice can be served on Employer/organisation/employee/supplier/designer.
What are the powers of an enforcement inspector (HASAWA Section 20)
Enter premises at any reasonable time and bring other (police/specialists)
Enquire into circumstances and causes of accidents or incidents
Insist that an area be left undisturbed
Demand to interview witnesses and obtain information from others
Request facilities
Examine, search, investigate records, copy records, take photos, take samples and tests.
Articles can be seized and destroyed
Examine safety related documentation
Carry out investigations or routine inspections
Any action to assist in fulfilling their function.
What is a prohibition notice?
In a situation with a high risk or personal injury is discovered inspectors can issue a prohibition notice, this comes into affect immediately and can stop a process or equipment being used.
Prohibitions notices can:
Be issued even if no direct contravention of law exists
Can take effect immediately or at a later time
Be served on a person including the person in control of the site
If prohibition notices are not complied with the person could be prosecuted.
