What is the automatic reporting restriction covering all juveniles concerned in Youth Court proceedings?
Section 49 of the Children and Youth Persons Act 1933
What does S49 of Children and Young Persons Act 1933 state?
Nothing should be reported that could lead to the identity of youth being revealed.
How does the media name young offenders?
Gives them nicknames
Spiderboy and Ratboy
What happens if you breach a RR
1) Organisation can face unlimited fine and prosecuted
2) professional embarrassment - story reported in publications such as ‘The Front Page’
Can S49 apply in a higher court?
No, S49 can only be applied in YC
What is the other RR that can be made to protect juveniles that are not in the Youth courts?
S45 of The Youth Justice and Criminal Evidence Act 1999. This is used for juveniles in adult courts
When does S45 lapse?
When child turns 18
How could a S49 be lifted? (4)
1) When a child turns 18
2) Public interest
3) Could he lifted to avoid an injustice of another young person - eg if people think crimes in area are being committed by another juvenile
4) If juvenile escapes custody and police looking for them
What did the government decide to do in 1930?
Separate juveniles and adults and give them their own courts, which is why Children and Young Persons Act was brought in 1933
What are punishment for young offenders? (7)
1) fines
2) community service
3) curfew order (tag)
4) Parenting order
5) Detention and training order
6) Imprisonment for very serious offences
7) Absolute discharge (will have criminal record but no punishment)
What is the clause in editors code of practice to do with children?
Clause 9 - Children

“Editors should be really avoid naming children U18 after arrest for a criminal offence, unless they can show the individuals name is already in the public domain or that the individual (or if U16 a parent) gives consent”
