How old must you be to be heard in the youth court?
aged 17 and under
The youth will always have their first hearing in the YC unless… where they will be in the magistrates court
- jointly charged with an adult
When will the youth be tried in the CC? (3)
- grave crime + sentence likely to be in excess of 2 years
- adult is being tried in the CC and its in the IOJ for youth to join
- specific offences: homicide, sexual offences etc
What is a grave crime? Give 3 examples
14 years maximum sentence for an adult
robbery, burglary of dwelling, murder
Where is the youth sentenced after trial in the CC?
In the youth court unless it would be undesirable or homicide
For an EW offence where both adult and youth plea NG where will the youth be tried if the court retains jurisdiction?
Magistrates court with the adult
Where will the youth be tried if the IOJ is not met?
Remitted to YC
What are the non custodial sentences available for the youth? (4)
- YRO (community order equiv)
- referral order (referred to panel)
- reparation orders
- orders against parent
