A

No. Automatic right but I do need to serve notice on the other party + mag court within 15 business days of sentence

The CC will then list the case for appeal as soon as possible

When must the courts use the sentencing guidelines?

A

The court must follow the relevant guidelines when conducting a sentencing exercise, unless it would be contrary to the interests of justice to do so.

What are sentencing guidelines?

A

Guidance on factors the court should take into account that may affect the sentence. They set out different levels of sentence based on the harm caused to the victim and how blameworthy the offender is (‘culpability’).

Is there a general right to bail for appellants?

A

No. So the granting of bail is at the court’s discretion

What is the court composition for re-hearing at Crown Court?

A

1 CC judge + 2 lay magistrates (1 if it would avoid unreasonable delay)

A

The procedure is exactly like the original hearing: prosecution will present facts and D will mitigate before judge makes a decision
