3 months imprisonment

- Damages or defaces
- Any building, structure, road, tree, property or other thing
- By writing, drawing, painting, spraying, etching or otherwise marking
- Without lawful authority and
- Without consent
Wilful damage S.11B
Possession of graffiti implements
S.11B elements
- Without reasonable excuse
- Has in possession
- A thing capable of being used to commit an offence against S.11A
- Reasonably inferred intent to use it to commit such offence

Community based sentence
