What are the four criteria that allows pharmacies to provide a wholesale supply to either other pharmacies or hospitals?
- It takes place on an occasional basis.
- The quantity of medicine supplied is small.
- The supply is made NOT on a profit basis.
- The supply of medicine is not for onward wholesale distribution (e.g. not sold to someone else).
Which classes of medicines are pharmacists only permitted to sell/supply by way of wholesale dealing to somebody else who is lawfully permitted to sell, supply or administer them to a patient?

No, the person has to be lawfully permitted to receive the supply by way of wholesale dealing.

- The Common Services Agency
- CCG
- Doctor or dentist
- Person lawfully conducting a retail pharmacy business
Can products which are NOT licenced be supplied by way of wholesale?
No, only medicines that are licenced in the UK can be supplied.
Should the medicines be labelled in a wholesale dealing?
No, the medicines should NOT be labelled.
What should be legally recorded on the POM register after a wholesale dealing?
Legally required:
- Date the POM was supplied
- Name, strength, quantity and form of POM supplied
- Name and address of the person the medicine was supplied to
- Profession of the person it was supplied to
- Purpose for which it was sold
Good practice:
- Wholesale dealing header
- Unique reference
- Cost
As the legislation does NOT specify what should be included in a signed order, by way of good practice, what following details should you have on it instead as a guidance?
The details you need to make a legal record of the supply. For example:
- Date the POM was supplied
- Name, strength, quantity and form of POM supplied
- Name and address of the person the medicine was supplied to
- Profession of the person it was supplied to
- Purpose for which it was sold
How long should the signed order/invoice be kept in the pharmacy?
2 years.
Do all who request a wholesale supply legally need to provide a signed order/invoice?
- No, only some are legally required to provide signed orders/invoices as outlined by Schedule 17 of Human Medicines Regulations.
- However, for others, a requirement for a signed order/invoice is NOT outlined.
- Despite this, it is good practice to obtain a written signed order/invoice for maintaining an audit trail.
When is it good practice to record the details of wholesale dealing in the POM register?
When a signed order is already retained in the pharmacy, POM register is done only for good practice.
When is it a legal requirement for a record to be made in the POM register after a wholesale dealing?
When no signed order/invoice is retained from the wholesale dealing.
