principal mining hazards relevant to work b) consideration of control measures for risks associated with principal mining hazards c) consideration of risk managed under principal control plans d) conduct of a review under clause 25
WHSMR CLAUSE 25
Review-1) mine operator must ensure the PMHMP is reviewed / revised if a control measure in the plan is revised under WHSR clause 38 or clause 10 of WHSMR.
WHSMR CLAUSE 10
Review of control measures-1)must review / revise control measures under clause 9 if a) an audit of SMS identifies a deficiency b) a worker is moved from a hazard or assigned to different work in response to a health monitoring report c) an incident referred to in clause 128 occurs d) any other notifiable incident.
2) must ensure that a control measure that is the subject of a request by a MSHR under WHSR 38 is reviewed / revised wether the request is made to the mine op or notified to the mine op by another person conducting business at the mine
3) A person conducting a business or undertaking at the mine who is not the mine operator must notify the operator of a request made to the person under WHSR clause 38.
4) A MHSR may request a review of a measure under WHSR clause 38 as if circumstances in sub clause 1 were included as a circumstance
in WHSR clause 38 4) a).
WHSMR CLASUE 11
Records of certain reviews of control measure-mine operator-1) applies to mine operator who has under WHSR 38 reviewed a control measure in response to a) a notifiable incident b) an incident referred to in clause 128
2) mine operator must keep a record of the following a) causes of an incident b) work health and safety issues arising from the incident c) recommendations arising from consideration of the incident d) wether action is required to review a control measure of the SMS and any outcome e) summary of changes to the SMS and affected PMHMP or PCP…
WHSMR CLAUSE 13
Duty to establish and implement safety management system-1) mine operator must establish a SMS
2) mine operator must implement theSMS as far as reasonably practicable
3) ensure no mining takes place at any place the SMS relevant is not establish & implemented
4) SMS must form part of overall management system
5) SMS must be designed as primary means of a) health and safer of workers b) health and safety of other persons not put at risk from mine or work carried out as part of mining.
6) Subject to Sub clause 7 the SMS must provide a comprehensive and integrated system for management of all aspects of risks to health and safety
7) SMS must comply with sub clause 6 having regard to a) nature, location and complexity of mining operations b) risks associated with those operations

Content of SMS-1) Must set out the following a) healthy and safety policy including broad aims in relation to safe operations b) arrangements for managing risks in accordance with clause 9 c) systems, procedures, plans, control measures that will be used to control risks to health and safety associated with operations including i) PMHMP under div 2 ii) PCP for mine d) management structure for management of health and safety including i) arrangements for filling temporary or permanent vacancies ii) requirements relating to acting positions iii) competency requirements for positions iv) positions that have responsibility for work health and safety and names of persons v) persons to execute statutory functions & responsibilities of each such person.

CLAUSE 5
Meaning of Principal Mining Hazard Management Plan-PMH is any activity, process, procedure, plant,structure, substance, situation or other circumstances that have the potential to result in multiple deaths in a single incident or a series of reoccurring incidents in relation to: a) ground or strata failure b) inundation or inrush of any substance c) mine shafts and winding systems d) roads or other vehicle operating areas e)air quality or dust or other airborne contaminants f) Fire or explosion g) gas outbursts h) spontaneous combustion i) subsidence. Any other hazard identified by mine operator under clause 34 WH&S regs.
