The function of the Court of Justice (By the 3 treaties)
- Rule on actions brought by a Member state, an institution or a natural or legal person
- Give preliminary rulings, at the request of courts or tribunals of the Member States, on the interpretation of Union law or the validity of acts adopted by the institutions

- The Union shall act only within the limits of the competencies conferred upon it by the member states in Treaties to attain the objectives set out therein

What is the Principle of Subsidiarity? Article 5 (TEU)
- In areas which do not fall within its exclusive competence, the Union shall act only if and in so far as the objective of the proposed action cannot be sufficiently achieved by the Member States
- The institutions of the Union shall apply the principle of subsidiarity as laid down in the Protocol on the application of the principles of subsidiarity and proportionality.

- The content and form of Union action shall not exceed what is necessary to achieve the objectives of the Treaties
