Public Land Use Controls
The regulation of land use by government organizations in the form of zoning laws, building codes, subdivision ordinances, and environmental protection laws.
Police Powers
The power of government to regulate the use of real property for the benefit of the public interest.
Enabling Acts
Laws passed by state legislatures authorizing cities and counties to regulate land use within their jurisdictions.
Setback
The distance from a front or interior property line to the point where a structure can be located.
Master Plan
Created for the purpose of providing for the orderly growth of a community that will result in the greatest social and economic benefits to the people in the community.
Zoning Ordinance
The zoning map, which divides the community into various designated districts and the text of the ordinance, which sets forth the type of use permitted under each zoning classification and specific requirements for compliance.
Nonconforming Use
The use of property in a zoned area is different from that specified by the zoning code for the area.
Planned Unit Developments (PUDs)
A type of zoning ordnance which permits a special use; thereby enabling a designated area or subdivision to have a combination of property types, such as, residential housing, recreation facilities, and business establishments.
Amendment
An actual change in the zoning code itself.
Variance
A permitted deviation from specific requirements of the existing zoning ordinance.
Special Use
An exception built into a zoning ordinance that must be granted if the criteria for the exception are met.
Overlay District
A zoning device that superimposes one zoning area over another.
Spot Zoning
When a certain property within a zoned area is rezoned to permit a use that is different from the zoning requirements for that zoned area. It’s illegal.
Subdivision Regulations (Ordinances)
Public control of the development of residential subdivisions.
Building Codes
Public controls regulating construction that establish minimum construction standards.
Certificate of Occupancy (CO)
A permit that allows the occupation of the structure by tenants or the owner.
Flood Hazard Area
Areas that are subject to certain federal laws and regulations that are made in the area. Must be covered with flood insurance.
Interstate Land Sales Full Disclosure Act
A federal regulation of the interstate sale of unimproved lots. Created to prevent fraudulent marketing schemes when land is sold.
Statement of Record
A document disclosing specific information that the developer must file with HUD before offering unimproved lots in interstate commerce by telephone or through the mail.
Property Report
Disclosure required under Interstate Land Sales Disclosure Act. Contains specific information about the land for the protection of the purchaser or lessee.
Deed Restrictions
Limits on land use i the form of covenants or conditions.
Covenant
Promise in writing, exists in a deed to benefit property that is sold or retained.
Run With The Land
Rights that move from grantor to grantee along with a title.
Restrictive/Protective Covenants
Restrictions in a deed placed on the use of land by the grantor. Such covenant are widely used by the developers of residential subdivisions.
Negative Covenants or Easements
Promises on the part of the purchasers of property in the subdivision to limit their use of their property to comply with the requirements of the restrictive/protective covenants.
Conditions
Restrictions that provide for a reversion of title if they are violated. If violated, ownership reverts to the grantor, his heirs, or assigns.
Private Land Use Controls
The regulations of land use by individuals or nongovernment organizations in the form of deed restrictions and restrictive covenants.
