Bylaws
Local or Municipal government can make laws to control unique issues within their community
Ex. Garbage pickup, snow clearing
Administrative Law
Def: laws and boards that govern the relationships between individuals and government departments
Ex. Labour Board, Worker’s Compensation Board
Civil/Private Law
Def: law governing relationships between individual and individuals or non government organizations
Ex. Wills, estates, employment law
Constitutional Law
Def: outlines the system of government and the jurisdictional authority between the provincial and federal governments
- sets standards that all other laws created must follow
- laws that breach constitutional law will be struck down
Contract Law
Def: laws that control rights and agreement between individuals and businesses
Ex. Returning goods, terms and agreements
Criminal Law
Def: punishments and identifying crimes
Ex. Robbery and jail time
Distinguishing a Case
Def: in common law a judge has the option to “distinguish a case” rejecting previous decisions and fashions a new precedent if it is believed that the case is unique
Domestic Law
Def: government and law within a country
Jurisdiction
A level of governments area of legal and political authority; pass and enforce laws, decide cases
International Law
Law that governs the relations between nations; created as customs
Procedural Law
Branch of domestic law that prescribes how substantive law is enforced
Property Law
Branch of private law deals with ownership and transfer rights of properties
Public Law
Branch of substantive law that governs the relationships between citizens and the government; includes constitutional, administrative, and criminal law
Statute Law
Middle of sources of law in Canada pyramid, consists of laws passed by elective representatives as acts
Substantive Law
Branch of domestic law that defines the obligations, rights, and duties of the levels of government and the citizens
