What is defined as immediate family under the victims rights act

A

Immediate family in relation to a victim means a member of the victims family, whanau or other culturally recognised family group who is in a close relationship with the victim at the time of the offence and includes

  • spouse, civil union partner or de facto partner
  • the victims child or step child
  • the victims brother or sister or step brother or step sister
  • parent or step parent
  • grandparent

A
  • an offence in sexual nature
  • serious assault
  • serious injury to a person, in the death of a person or in a person becoming incapable or
  • an offence of another kind that has led the victim to have on going reasonable fears in relation to their physical safety or the physical safety or security of 1 or more family members
