Section 266 sale and supply of alcohol act

A

Closure of licences premises by police

Any Constable may order the closure of a licensed premises if
- a riot is taking place or rgtb a riot may occur
- fighting or serious disorder or rgtb fighting or serious disorder is about to break out
- significant threat to public health or safety
- if the conduct on any licensed premises amounts to a substantial public nuisance or
- if there are rgtb offences have been committed on the premises that carry a maximum penalty of five years or more and there is significant risk of further such offences being committed on the premises if it remains open

Close for a period of 24 hours, order any person to leave.

May use reasonable force

Licensee or manager can apply to a district court judge or any two or more justices or one or more community magistrates for revocation of the order.

The judge, magistrate or justice May
- revoke the order either conditionally or unconditionally
- may refuse to revoke the order

Any licensee or manager who keeps the premises or specified part of the premises open commits an offence

What are the penalties under s 266 if a premises remains open following a notice to close

A

In the case of a licensee
- a fine not exceeding $10000
- suspension of the licensees licence for a period of not more than 7 days

For the manager
- a fine of not more than $10000

A person who sells any alcohol from the licensed premises at any time while the order is in effect commits an offence and is liable on conviction to a fine of not more than $3000

Section 267 sale and supply of alcohol

A

A Constable or inspector May at any reasonable time enter and inspect a licensed premises to ascertain whether the licensee is complying with the provisions of this Act and the conditions of the license.

A Constable or inspector may enter a licensed premises at any time to enter and inspect when he or she believes on reasonable grounds that any offence against this act is being committed.
