What is section 7 VRA 2002?
Legislates expected behaviour - treat victims with respect, empathy, compassion, respect their privacy and dignity
What is section 8 VRA 2002?
Victims have a right to access to services
What is section 11 VRA 2002?
Information about programmes and services - inform them asap of services available to them, they have the right to know
What is section 12 VRA 2002?
Keep victims informed of progress of the case; describe what will happen and what’s expected of them
What is section 51 VRA 2002?
Return of property held as evidence - all property, unless it’s the offender’s, or needed for EM, will be returned as soon as practicable
Under the Victims Rights Act, a victim is someone who:
- Person who has an offence committed against them
- Because of an offence, they suffer physical injury or loss/damage to property
- Parent/legal guardian of a CYP, unless the parent is the offender
- Member of immediate family who as a result of the offence, dies or is incapable
What does s29 VRA 2002 cover?
This is victims of specified offences
What are specified offences?
- Offence of a sexual nature
- Other serious assault
- Had resulted in their serious injury, incapacity, or death
- Offence of another kind, caused victim to have ongoing fears for their safety or for family.
What is a CSV1 form?
Court Services for Victims referral form, ensures victims receive support from Court Victims Advisor.
Must be given along with summary of facts to CVA on or before defendants first appearance in court
Who can go on the Victim Notification Register?
Victims of specified offences outline under section 29 VRA 2002
What is the purpose of the NIA Victim Contact Node?
This records contact with victims: every contact must be added.
Victims should be contact at every change in the case.
