Section 4 of the Victims Rights act 2002. Who is a victim?

A

A person against whom an offence is committed against. They suffer physical injury or loss or damage to property caused by someone else. The parents or legal guardian of a person under 18 years old or immediate family.

They are also a victim if they suffer from any form of emotional harm because of the offence committed by another person.

A

Treats victims with courtesy and compassion and respect their dignity and privacy.

A

A

What is section 12 of the Victim rights act 2002?

A

Information about proceedings.

Victim and others disadvantaged by an offence must receive information about the investigation of the offence and specific actions being taken against the accused person and specific information about the proceedings.

What is section 51 of the VRA?

A

Victims property held as evidence must, as far as possible, be returned as soon as practicable after it is no longer needed (s51), unless the person advises they don’t want it returned.

What is section 29?

A

Victims of offences specified in section 29 can go to the Victim Notification Register.

The offence must be: a sexual assault or other serious assault, serious injury to a person or death, ongoing fears on reasonable grounds for their physical safety or security (including family), the victim is a child, victim dies or rendered incapable.

Summary of O/C responsibilities regarding s.29 notification

A

When a section 29 applies to a victim the OC must check that the qualifying offence is correctly populated and the OC must inform the victim at the time of the alleged offenders arrest that they have the right to apply to be on the notification register and be notified about their bail release escape death and also explain their rights.
