What is a local action and what effect does that have on venue?
A “local action” is a case involving title to land - venue in such actions must be placed in the county where the land lies.
General venue rule when the defendant is a Georgia resident
Generally, venue must be laid in the county where the defendant resides when the case is filed.
What is the venue rule in cases with multiple defendants - all of whom are Georgia residents?
Venue may be placed in the county where any of the defendants resides.
Venue in divorce and alimony cases
If the defendant is a Georgia resident, venue must be laid in the county where she resides. If not, venue may be laid in the county where the plaintiff resides.
Venue under the Long Arm Statute
- Venue lies where a substantial part of the act or omission took place.
- Venue is proper where a Georgia co-defendant is subject to venue.
- Venue is not lost if a judgment is returned in favor of a resident defendant.
Venue rule for corporations
A corporation resides in the county where it has its registered office.
Venue rule for impleader claims
A third-party defendant impleaded into a case has no right to be impleaded in the county of her residnece.
Transfer Rules for Improper Venue
A case in which venue is laid in an improper county must be transferred to a proper county.
