Criminal Law Act 1977 - Using or threatening violence to secure entry
Any person who, without lawful authority uses/threatens violence for the purpose of securing entry into any premises for himself or another person provided that
a) someone is on the premises at the time who is opposed to the entry
b) the person using/threatening violence knows this
Failing to leave a premises
Any person who is on any premises as a trespasser fails to leave on being required to do so will be guilty of an offence
Trespass as a Criminal Offence
- Forms part of a burglary
- For the purpose of living in a residential building for any period of time
- Forms offence of criminal trespass on land
- Forms offence of aggravated trespass on land
Squatting Offences
A person commits an offence if
a) they are in a residential building as a trespasser
b) knows/ought to know that they are a trespasser
c) the person is living in the building or intends to live there for any period
