Government rules that are broken by society.
Criminal Law
legal services paid for by the government, available to persons unable to afford a lawyer
Legal Aid
the fact of being the producer (cause) of an effect, result, or consequence.
Causation
a defence that the accused was in a different place, not at the scene of the crime, when it took place.
Alibi
a court document ordering a person to appear in court for a specific purpose. (Spouses are an exception)
Subpoena
factors that increase the responsibility of the offender, and that may increase the penalty
Aggravating Circumstances
a defence that the accused took reasonable care not to commit the act or that the accused honestly believed his or her actions were innocent. You did the crime but you aren’t guilty because you acted responsibly.
Due Diligence
imprisonment or confinement.
Incarceration
a serious agreement or arrangement to commit an unlawful act. Has to be planned, not just said to each other.
Conspiracy
the party who requests an appeal in criminal court, either the defence or Crown.
Appellant
to induce or lure a person into committing an offence.
Entrap
a witness’ solemn agreement to tell the truth
Affirmation
to keep the jury together and away from non-jurors until it reaches a decision.
Sequester
the reason for committing a certain act.
Motive
being tried twice for the same offence, which is prohibited. Once you are deemed not guilty for a crime at the last court of appeals you can’t be tried for that crime again.
