Explain the concept of social cohesion and how society can achieve this.

A

When society acts in peace harmony and order. Individuals can achieve this by knowing and understanding the laws that apply to them and using the legal system to solve disputes.

Distinguish between Common and statute law.

A

Common law is the overall term for laws made by judges through statutory interpretation and precedents, whilst statute law is the overall term for laws made by parliament in the form of Acts and Legislations.

Outline three characteristics of an effective law.

A

An effective law should be able to be enforced by officers of the law if it isn’t members of society will be unlikely to follow it.
should be stable, if a law is not stable and is changing too often then people will not be able to follow it.
Should reflect societs values, if members of society don’t believe that the law reflects the values of the community they will be less likely to follow it.

Describe reasons for the court hierarchy.

A

Specialisation, different courts specialise in certain things therefore saving timeand money.
Appeals, if an indvidual disagrees with the judges decision they can make an appeal to a higher court to retake the case.
Precedent, so higher courts can make precedents that lower courts must follow.
