When may provisions of the CBA be suspended?
During declared emergency (wage rates and monetary fringe benefits may not be suspended)
What is the definition of a grievance?
Claim or complaint from a member of the CBU (or group of members) that the county has violated a provision of the CBA.
What information must all grievances contain?
1) Specific articles/sections violated
2) Statement of the grievance (facts, dates, events)
(Sender of grievance email satisfies signature requirement. Union grievance must be emailed by a Union officer.)
Grievance – Step One
1) Employee presents grievance to AOC within 7 business days from when employee or Union knew or should have known of alleged violation.
2) AOC tries to resolve grievance.
3) AOC informs employee/Union of department’s decision within 7 business days.
Grievance – Step Two
1) Employee has 7 business days from department Step One decision to present written grievance to County Administrator.
2) County Administrator has 20 business days to conduct meeting with grievant and Union rep.
3) County Administrator has 15 days following meeting to issues decision.
Grievance – Step 3
1) Union has 14 days after County Administrator’s decision in Step 2 to request arbitration.
2) County and Union have 14 days to agree on an arbitrator.
3) If they cannot agree, Union will request Federal Mediation and Conciliation Service submit names of 7 arbiters.
What is the result if the county fails to meet timelines established by grievance article?
Employee may move on to next step.
What happens when a Captain’s OT assignment is canceled within 20 hours of the start time?
Shall receive minimum of 2 hour’s pay.
What happens if a promotional probationary employee fails to demonstrate that he can perform the job?
May have one-time probation extension of 6 months or be returned to prior rank.
How long is the probationary period for employees who have been demoted to stepped down while under investigation (Reversion).
1 year
How long does the county have to fill a position that becomes vacant?
30 days
Duties of Health and Safety Committee
Review all injuries/vehicle damage Recommend steps to prevent reoccurrence Provide Fire Chief with findings and recommendations for actions. Review industry health and safety trends Publish minutes to all stations.
When is vacation accredited to an employee?
One the last day of the pay period.
What conditions must be met for county to repair or replace an employee’s eyeglasses, contact lenses, sunglasses and personal watch?
1) Damaged or lost while employee performing duties.
2) Damage/loss was not result of employee negligence.
3) Employee reports damage within 24 hours.
4) Person in charge certifies damage/loss during duties.
5) Employee sends copy of IR to AOC.
