DL
Parliament give powers to other bodies to make laws on their behalf
Bylaws
Made by local councils or public bodies
E.g. local Government Act 1982 local council permission, parking on match day
Includes bylaws restricting alcohol in public, or dog mess, or litter
Railway Regulations act, feet on train, Fadol
Statutory Instruments
Government ministers, heads, 3000 passed per year
Will have a parent act to pass power, including what they can change and the process
E.g. Dangerous Dogs act, Home sec adds breeds
Order in council
Monarch and privy council (PM, royals, senior judges, politicians)
have no vote
Laws in: emergencies (civil contingencies act)
Effect to EU directives
transfer responsibility between gov departments
Acts or parts of acts into force
Reason: time
Allow parliament more time to deal with more urgent issues (e.g. national covid strategies, local covid strats for locals)
Reason:Local Knowledge
Local councils have clearer ideas on laws needed in their local area
E.g. Local Government act - Wolverhampton council have better idea on parking than Westminster
Reason: Expert knowledge
Heads of govt departments should be experts on specific areas of law
E.g. Home dept and police practices PACE 1984
Reason: Emergency
Parliament can take months to inroduce new laws, SI’s and OIC’s can be days / hours
E.g. OIC freezing bank accounts of suspected terrorists after 9/11
However parliament too - coronavirus act 2020
Reason: Future needs
Acts of parliament can be future proofed by being able to be amended through SI’s
E.g. dangerous dogs act 1991
Reason: Flexibility
Set process for law making doesnt have to be followed by delegated body
e.g. Local gov act 1972
