What are the points to prove for TWOC ?
-WITHOUT CONSENT IF OWNER/LAWFUL AUTHORITY
-TOOK A CONVEYANCE
-FOR YOUR OWN/ANOTHERS USE OR
-KNOWING THAT ANY CONVEYANCE HAS BEEN TAKEN WITHOUT SUCH AUTHORITY DRIVES OR ALLOWS HIMSELF TO BE CARRIED IN OR ON IT.
What Section is Aggravated TWOC?
Section 12 A THEFT ACT 1968
In what situations is the offence of aggravated TWOC committed?
Vehicle HAS TO BE mechanically propelled PLUS any of the below
- Damage caused to the vehicle during
- Injury caused to anyone during
- If the vehicle was driven dangerously
- Due to the vehicle being driven dangerously damage has occurred to ANY PROPERTY.
- Death to any person
What is the offence type and outcomes for aggravated TWOC ?
Triable Either way
IF death is caused, max 14 years imprisonment.
Disqualification from driving (min 12 months)
And
Endorsement of licence (between 3-11 points)
When is a vehicle considered ‘recovered’?
- Returned to rightful owner
- Other lawful possession or custody (including Police)
