What is Common Law?
Dates back to the Magna Carta. Law applied across whole of the country.
What is Statute Law?
Current legal system in England and Wales. Parliament make and amend.
What is Case Law ?
Interpretations of the law. Law produced after cases reach court.
What are Acts of Parliament ?
Definitions of offences, powers of arrest and penalties.
What are Statutory Instruments?
Allow details of an act to be revised without parliament.
What are bye-laws ?
Local laws made by local authority. Approved by Secretary of State.
What % of cases are dealt with in Crown ?
5%
What is a Summary only offence ?
Dealt with in Magistrates.
What is a either-way offence ?
Magistrates decide if they can deal with it or if it needs to be sent to Crown.
What is an Indictable offence ?
Can only be dealt with in Crown.
What are 3 indictable offences ?
Serious assaults, Murder, Sexual assaults.
What is Actus Reas?
A persons ACTIONS.
What is Mens Rea ?
A persons STATE OF MIND. The degree of Mens Rea can vary.
What are Strict Liability offences ?
All that needs to be proven is the guilty act.
What is the Burden of Proof ?
Prosecution to prove the guilt of the defendant not on the defendant to prove their innocence. ‘Beyond Reasonable Doubt’
