Tribunals Act
The Tribunals Courts and Enforcement Act 2097 - unified framework for all tribunals making them more organised and simplified
What Are Tribunals
-Tribunals are forums used instead of a court for deciding certain types of disputes, they are less formal then courts
-composed of three people, one legally qualified two experts
-enforce rights granted through social welfare and legislation
Employment Tribunals
Deals with issues such as claims of unfair dismissals, discrimination in the workplace or redundancy
Preliminary Matters
-Claim must be made within 3 months from the event
-ACAS must be contacted to see if there is a resolution
-Claimant has to fill in ET1form and send it to employers tribunal
-Respondent fills an ET3 to respond to the claim
-both sides are given opportunity to put their case forward
The Hearing
-In the full evidence is taken on oath and their are set rules
-If the tribunal is in favour of the employee they may encourage settlement
-If settlement can’t be reached, tribunal can award compensation
-If the claim is lost the employee doesn’t pay the employers cost but is responsible for the costs of lawyers used
