Totality Rule Flashcards
1
Q
What does the Totality Rule provide?
A
Where there are several claims or causes of action between the same or different parties, the amount of the demand shall be the totality or sum of all the claims in all the causes of action, irrespective of whether such causes of action arouse out of the same or different transactions. (Sec. 33[1], B.P. 129, as amended)
Hence, the total amount of such claims shall be the basis of the court’s jurisdiction, not the amount of the individual claims.
