A

Impose the laws set out by the government, overseen by the Ministry of Justice. The Judiciary work with the courts to convict the guilty and sentence offenders.

Relationship between the Police and the CPS?

A

CPS advise the police on what evidence is needed, decide the charge based on the evidence collected by the police, and inform the police of the decision to charge.

A

Police will take anyone in custody to court and may also give evidence in court.

A

Prisoners held locally when arrested are transported to prison if ordered to by the courts. Police will also arrest offenders recalled on probation and return them to prison.

Responsible for probation management and the management of offenders within the community.

The CPS appears in court as part of the prosecution’s legal teams, and they will prepare criminal cases for court.

A

Arrange safe transport from prison to court and vice versa, prisons also arrange video calling for prisoners unable to attend in court. They impose sentences set out by the courts, hold defendants who are on bail in custody awaiting trial.

Relationship between HM Prison Service and the National Probation Service?

A

Work in prisons and parole board to decide if prisoners should be released and support them in the community (post-prison).

Relationship between HM Court and Tribunal Service and the National Probation Service?

A

Probation officers may need to provide evidence in court, relating to the offenders behaviour whilst on probation, may provide reports for the courts (pre-sentencing)- if they are considering imposing a probation order. Probation Service has to impose community sentences or probation orders set out by the courts/judiciary.
