Where is the basis of British Health and Safety law set out?
In the Health and Safety at Work Act 1974
What does the Health and Safety at Work Act 1974 indicate?
It indicates the duties that employers have towards their employees and members of the public, and the duties that employees have to themselves and to each other.
Employers have a duty to…
- to carry out a risk assessment of the workplace
- to make arrangements for reducing risks that have been identified through this assessment
- to nominate and train people who would be responsible for implementing arrangements to ensure safety at the workplace
- to develop and set up emergency procedures
- to provide information and training to employees on relevant health and safety matters
- to work with other employers who share the same workplace to ensure optimum health and safety conditions
What should be displayed in the workplace? Why? Who does it need to be approved by?
There should be a poster hilighting health and safety law placed in a prominent place in the building. This allows all those working there to familiarise themselves with these basic principles. Alternatively, employees can be provided with a leaflet containing the same information called “Your Health and Safety- a Guide for Workers”. All posters and leaflets must be approved by the Health and Safety Executive.
What are employers of 5 or more employees required to have? What are some examples of what it might contain?
To have a written health and safety policy and a two part risk assessment.
- managing the health and safety risks arising from the work activities
- providing and maintaining a safe and healthy work environment
- consulting with employees on matters relating to their health and safety
- providing appropriate information and training
- ensure that all employees are able to do their tasks
- preventing accidents and cases of ill health caused by work
- reviewing the health and safety policy regularly
