Threatening Life, Person, or Family of Public Official or Public Employee
Class: Class F Felony
General Sessions Court
Penalty:
Provision A; up to $5000 or up to 5 years or both
Provision B: up to $500 or up to 30 days or both
Elements:
1. (Provision A )unlawful for person knowingly and willfully to deliver convey to a public official, teacher or principle of a elementary or secondary school any letter or paper, writing, print, missive, document electronic communication or verbal communication which contains threat to take life of, inflict bodily harm upon that person or members of his immediate family if it is related to their professional responsibilities.
- (B provision) same but to public employee related to their official responsibilities
Public Official -elected or appointed official of US, the State, County, Municipality, or other political subdivision.
Public Employee does not include a teacher or principle of elementary or secondary school.
Immediate Family- spouse, child, grandchild,mother,father, sister,brother of the public official, teacher, principle or public employee
Resisting Arrest
Class: Class C Misdemeanor
General Sessions Court
Penalty: up to 1 year in prison and or fine $500-$1000
Elements:
1. Person knowingly and willfully
2. resists any lawful arrest
Assault on Officer while Resisting Arrest
Class: Class E Felony
General Sessions Court
Penalty: prison up to 10 years and or fine of $1000 to $10000
Elements:
- Person knowingly and willfully
- assaults,beats or wounds a law enforcement officer
- resists any lawful arrest
Resisting Arrest with Deadly Weapon
Class: Class E Felony
General Sessions Court
Penalty: prison 2 to 10 years
Elements:
- Person who uses or threatens use of a deadly weapon against officer
- When person is in possession or claims to be in possession of a deadly weapon
- While resisting lawful efforts of LEO to arrest him or another person
deadly weapon any instrument which can inflict deadly force
separate statute for hindering, preventing or obstructing officers or other persons charged with execution of warrant
