Class: Exempt Misdemeanor
Magistrate Court

Penalty: Fine $100 or 30 days jail

Elements:

1. One may not transport alcoholic liquours (regardless of % alcohol) in a motor vehicle
2. If the cap or seal is opened or broken
3. In any motor vehicle except in trunk, luggage compartment or cargo area that is separate from the driver and passenger’s compartments.

Question 2

Open Container of Beer or Wine in Vehicle

Answer 2

Class: Exempt Misdemeanor
Magistrates Court

Penalty: up to $100 and up to 30 days in jail
Elements:
1. One may not have an open container of beer or wine
2. in a motor vehicle of any kind while located on the public highways or highway rights of way of this state, except in the trunk or luggage compartment

Question 3

Purchase or Possession of Beer or Wine by <21

Answer 3

Class: Exempt Misdemeanor
Court: Magistrate
Punishment: fine $100 to $200, 30 days or both
Elements:
1. Person under the age of 21
2. Purchase, attempt to purchase, consume or knowingly have in his possession
3. Beer, Ale, Porter Wine, or other similar or malt or fermented beverage

18 year olds may lawfully remove, serve alcoholic beverages in establishments licensed to sell

Purchase or possession of Liquor by a Minor

Answer 4

Class: Exempt Misdemeanor
Court: Magistrate
Punishment: Fine $100 to $200 and or imprisonment 30 days
Elements:
1. A person under the age of 21 may not
2. Purchase, attempt to purchase , consume or knowingly have in his possession alcohol
OR
3. falsely represent his or her age for purposes of procuring alcohol
