What is the rule of law?
Principle that law should govern a nation, as opposed to it being governed by obituary decisions of individuals or gov officials.
When did the UK grant its citizens the right to go to Strasbourg with a European case?
1966
What is meant by an absolute right?
Duty placed upon state that must be performed in all circumstances, such as right to use Article 2 and not to be tortured (Article3)
What is meant by limited rights?
Where a right is set out, such as right to liberty in A5, sets out circumstances when the right is limited.
What is meant by qualified rights?
Due to public interest, have to protect the rights of others.
What is meant by a human right?
Fundamental assumption, each individual deserves to be treated with dignity
What are the basic principles of human rights?
-Belongs to everyone
