Element : Theft by Taking

AFTER obtaining possession or control of that property in whatever manner.
Dishonestly : Defenition
Without a belief that there was consent or authority from the owner.
Claim of Right : Defintion
A belief by a person, at the time of an act they or someone else had a right to own or possess the property.
Takes : Definition
When the offender moves the property or causes it to be moved.
Uses or Deals : Definition
To gain possession or control of property and then begin to make decisions about that property as though you were the owner.
Ownership : Definition
A person is regarded as the owner of any property that is stolen that the time of the theft the person has:
- Possession or control of that property
- Any interest in the property.
- the right to take possession or control of the property.
Property : Definition
Property includes real and personal property and any estate or interest in any real or personal property.
- Money
- Electricity
- Any debt
- Any thing in action
- Any other right or interest.
Punishment for Theft.
-Important to understand the value of the theft because it determines the penalty. (Section 223 of the Crimes Act 1961)
a) Theft of person in a special relationship : a term not exceeding seven years.
b) If the value of the property exceeds $1000 : a term not exceeding seven years.
c) If the value of the property exceeds $500 : a term not exceeding one year.
d) If the value of the property does not exceed $500 : A term not exceeding 3 months.
