Theft
Theft - Section 1 Theft Act 1968
A person is guilty of theft if he or she:
“Dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it.”
Robbery
Robbery - Section 8 Theft Act 1968
A person is guilty of robbery if they steal and immediately before doing so, or at the time of doing so, and in order to do so, use force on any person, or outs or seek to put, any person in fear of being then and there subjected to such force.
NO THEFT, NO ROBBERY
Burglary
Burglary - Section
A person is guilty of burglary if, he/she enters any building or part of a building as a trespasser with intent to commit any offences mentioned in the subsections or having entered any building/part of a building as a trespasser he/she steals or attempts to steal anything within, inflicts or attempts to inflict on any person therein GBH.
Burglary Section 9(1)(a)
Burglary Section 9(1)(a) Theft Act 1968
Requires proof that the entry took place with the INTENTION of:
- Stealing
- Inflicting GBH
- Criminal Damage
Burglary Section 9(1)(b)
Burglary Section 9(1)(b) Theft Act 1968
Requires proof that the entry took place and the defendant:
- Stole or attempted to steal anything.
- Inflicted GBH upon a person or attempted to do so.
Aggravated Burglary
Aggravated Burglary - Section 10(1) Theft Act 1968
An offence is committed by any person who commits a burglary AND at the time has with them:
- Weapon of Offence
- Imitation Firearm
- Firearm
- Explosive
(WIFE)
Taking Without Consent (TDA)
TDA - Section 12 Theft Act 1968
A person commits an offence who without consent of the owner or other lawful authority. Takes a conveyance for his own or another’s use.
Or,
Knowing that a conveyance has been taken without authority, drives it.
Or,
Allows himself to be carried in it.
Taking a Pedal Cycle
Taking a Pedal Cycle - Section 12(5) Theft Act 1968
A person commits the offence who:
- Takes a pedal cycle.
- Without consent of the owner.
- Other lawful authority
- Rides a pedal cycle knowing that it has been so taken.
Stealing Electricity
Stealing Electricity - Section 13 Theft Act 1968
When he/she dishonestly uses it without due authority or dishonesty causes it to be diverted or wasted.
