STOP and SEARCH

A Police Constable may detain one order to search any person, vehicle or anything which is in or on a vehicle in any place to which the public has access, if they have reasonable grounds for suspecting that any of below articles will be found:

  • Stolen Goods
  • Prohibited Articles
  • Articles for Damage
  • Fireworks

A Constable lawfully on premises may seize anything if there are reasonable grounds to believe:
a) Obtained in consequence of an offence
b) That is evidence in relation to any offence, and is necessary to prevent the evidence being:
C - Concealed
L - Lost
A - Altered
D - Damaged
D - Destroyed

Property seized may be kept for as is necessary if it is evidence of an offence and is needed for court, or it is needed for forensics or investigation into any offence. Also to enable enquires to establish lawful ownership if suspected that it is from an offence.
