Theft of Property Lost, Mislaid, or Delivered by Mistake

A

Elements:

  1. the defendant came into control of property of another;
  2. he knew the property had been lost, mislaid, or delivered by mistake as to the nature or amount of the property or the identity of the recipient;
  3. he failed to take reasonable measures to restore the property to the person entitled to the property; and
  4. his intent was to deprive the owner of the property.

Receiving Stolen Goods

  1. ∆ intentionally received, retained, or disposed of movable property of another; AND
  2. either:
    1. knew that it had been stolen; or
    2. believed that it had probably been stolen, unless
