when should power to refuse a dissolution be exercised ?
t seems that power to refuse a dissolution should be exercised if alternative government is feasible, can be assured of a working majority, and be expected to carry on for a reasonable amount of time.
Also in circumstances where there is a “hung Dáil” it is arguable that a president may be justified in granting a refusal.
describe the employment Equality bill, 1996
In the constitution there was an obligation on the employer to accommodate disabled worker’s needs, and to bear the full costs of this accommodation unless it gave rise to ‘undue hardship’ .
The definition of the term “disability” in the Bill was such that it was impossible to estimate in advance what the likely cost of reasonable accommodation would be to an employer’
It was held that This was an attack on the employer’s constitutional right to carry on business and the legislation was unconstitutional
how was the employment quality bill, 1996 reformulated ?
It was Reformulated as The Employment Equality Act 1998- employers must give ‘reasonable accommodation’ to disabled worker’s needs, but any burden should not be ‘disproportionate’. Once the supreme court accepts the bill , its constitutionality cannot be challenged again .
what is a money bill ?
A money bill is a bill proposing the raising of revenue or the expenditure of monies by the state.
examples of money bills ?
A Good example would be the annual Finance bill and the appropriation bill each year.
