What are the President’s foreign affairs powers?
President has control over military decisions. Congress can however cut off funding.
Treaties are negotiation by President but require 2/3 vote of the Senate.
Executive Agreements do not need Senate approval but can be over rode by statute.
What is the authority as chief executive?
President’s authority varies with degree of congressional authorization.
- Highest power - acts with Congressional authorization (express or implied)
- When Congress has not spoken - diminished authority
- Weakest - Congress has spoken to the contrary.
What is the power of appointment and removal of officers?
Only president can hire or fire executive officers.
Senate has power of rejection.
Executive Officers = Anyone who takes action on behalf of US.
Congress cannot give executive power to an officer ir can hire or fire.
What is the veto power?
Once a bill is presented to President, he has 10 days to act.
Congress can override veto with 2/3 vote in each house.
If after 10 days, President does nothing and Congress in session, bill becomes law.
No line item vetos (refuses part of bill).
What is the pardon power?
President may grant pardons for FEDERAL crimes, except no pardons for impeachment
Cannot pardon for state crimes.
Can be given to individuals or groups.
May be given anytime after commission of offense.
