Risk Assessment
(1) Every ER shall make a suitable and sufficient RA of -
a) the risks to the health and safety of his EES to which they are exposed whilst they are at work and
b) the risks to the health and safety others arising out of or in connection with the conduct by him of his undertaking
(2) Every self employed person… as above
(3) RA shall be reviewed by the ER or Self employed person if
a) no longer valid
b) significant changes which could affect the RA data
(4) Not employ a young person unless they have completed a RA taking into account -
(5)
a) inexperience, lack of awareness and immaturity
b) layout of workplace and workstation
c) nature, degree and duration of exposure to physical, biological and chemical agents
d) use of work equipment and handling
e) processes and activities
f) extent of H and S training
(6) where the ER has 5 or more EES he shall record
a) the findings of the RA
b) any groups of EES identified by it as being especially at risk

Principles of Prevention to be applied
Where an ER implements any preventative and protective measures he shall do so on the basis of
a) avoiding risks
b) evaluating the risks which cannot be avoided
c) combating the risk at source
d) adapting to individual -design of workplace, equipment, alleviating monotonous work, reducing effect on health
e) adapting to technical progress
f) replacing the dangerous with the non- or less- dangerous
g) policy of prevention - covering technology, organisation of the work, working conditions
h) collective protective measures priority over individual protective measures
i) appropriate instructions to EES

H and S arrangements
1) Every ER shall make and give effect to appropriate arrangements (considering the activities completed and size of undertaking) for the effective

2) 5 or more EES these arrangements must be recorded

Health surveillance
Every ER shall ensure that his EES are provided with such H surveillance as appropriate having regard to the risks of their H and S which are identified by the assessment
E.g. noise, vibration, radiation, hazardous substances

H and S assistance
1) ER to appoint appropriate level of assistance - competent persons i.e. H and S advisors etc. For the size / hazard profile of an org.
2) ER to make arrangements for co-op between them
3) ER’s appointed H and S advisors must be given by the ER adequate time, resource, means at their disposal - with regard to the size of the undertaking
4) i- ER must ensure - that any H and S advisor (who is not an EE) is informed of any factors known to, suspected by or any persons affected by the ER with regards to their H and S
ii- And is given all ITS which would be provided to an EE regarding H and S
6)
