in 1896 homer plessy who was a tanned skin African American notified the driver of a train that he was black and sat in the white area they tried to move him to the black area but he resisted, he took them to court and the supreme court ruled that as long as facilities were equal segregation complied with the constituion and therefore created legal basis states to enforce it.
