Express Contract
any contract in which both parties entering into the agreement explicitly state exactly what they are agreeing to do. Orally or written.
They can invalidate the legal doctrine of employment-at-will so care must be taken in the workplace.
Weingarten Rights
In a union setting, when an employee requests a co-worker’s presence. When incited:
Discontinue the interview until the co-worker arrives
decide not to conduct the interview at all and make any disciplinary decision based on other facts
Give the employee the choice of voluntarily waiving the Weingarten rights and continuing the interview or having the employer make disciplinary decisions without an interview
Six Sigma
a quality philosophy developed by engineers at Motorola in the 1980’s. As a precise way to measure process defects, the six sigma quality standard is measured on a defects per million basis.
Whistle-blower
an employee who makes a complaint to a federal agency, claiming that illegal activity has occurred.
Sarbanes-Oxley Act (SOX) provides broad protection for employees initiating such reports. These are enforced by OSHA
The Safety and Health Achievement Recognition Program (SHARP)
a program under OSHA that recognizes small, high-hazard employers for requesting an OSHA Consultation, correcting violations and developing safety program
The National Institute of Occupational Safety and Heallth (NIOSH)
created under the OSH (Occupational Safety and Health) Act and is charged with researching and evaluating workplace hazards and recommending ways to reduce the effect of hazards on workers
The Occupational Safety and Health Administration
created by OSH, responsible for setting and enforcing safety standards for all industries
Compliance Safety and Health Officer (CSHO)
an individual trained on OSHA standards and how to recognize safety and health hazards. Responsible for conducting OSHA inspections
Six Sigma Team Structure level
Quality Leader/Manager - reports to the CEO or president in order to remain objective. this role represents customer requirements and focuses on continually improving operations
Master Black Belt - generally work with a single function (i.e. Marketing, Accounting). Works with the process owners to implement DMAIC methodology and ensures the project stays on track
Process Owner - Individuals responsible for a specific process in the org.
Black Belt - work full time on quality initiatives, coaching green belts to improve their quality skills
Green Belt - have received Six Sigma training and participate on project teams part-time while continuing to work in another role.
Ally Doctrine
a neutral employer who become a target of a picket line because he allied with a struck employer
Alter Ego Doctrine
A doctrine used to protect creditors from frauds perpetrated by shareholders. Also used to prevent employers from evading their collective-bargaining responsibilities
Double-breasting
When an employer is the owner of a union shop and a non union shop
Straight-line Operations
When an organization is struck only because it is interlocked in a single economic enterprise, where a complementing business is under strike
