What is section 12 of the Theft act 1968?
A person shall be guilty of an offence if, without having the consent of the owner or other lawful authority, he takes any conveyance for his own or another’s use or, knowing that any conveyance has been taken without such authority, drives it or allows himself to be carried in or on it.
How does TDA differ to theft?
Theres no need to show intention to ‘permanently deprive’.
If a suspect argues that they never intended to keep the conveyance this is irrelevant -they’ve still committed the offence.
What is meant by a conveyance?
The vehicle must be designed to carry a driver or passenger.
What could be classed as lawful authority?
Police officers
Vehicle removal officers
Bailiffs repossessing cars
What is meant by allowing himself to be carried?
A person knew the vehicle they were in wasn’t the drivers

Aggravated Vehicle Taking
What aggravates a vehicle taking?
• A vehicle was driven dangerously on a road or other public place
• An accident occurred by which injury was cause to any person
• An accident occurred by which damage was caused to property other than the vehicle
• Damaged was caused to the vehicle
