What is the definition of Robbery as per Section 8 of the Theft Act 1968?
A person is guilty of an robbery if the person steals, and immediately before or at the time of doing so, and in order to do so, they use force on any person of puts or seeks to put any person in fear of being then and there subjected to force.
What is the maximum sentence for Robbery?
Life imprisonment
What must you have in order to have a robbery?
Theft as per Section 1 of the Theft Act.
Can cars or bikes be “Robbed”?
No
If someone has stolen an item from a victim an the victim tries to stop the offender and the offender then punches the victim in order to make off is this a robbery?
No. Force must be used IN ORDER TO commit theft not to make an escape.
Is threatening to use violence in order to dishonestly appropriate property robbery?
Yes
Does threat of violence have to be at the Person who has the property?
No, if a victim is walking with there friend and a suspect comes over a puts the friend in a head lock then demands the victims watch this is robbery.
However, if the victim was by themselves and there friend has just gone to the toilet a suspect came over and said give me your watch or I’ll smack your friend this is not robbery.
