What is a summary offence
A
Offences listed in the crimes act (vic 1958) and the wrongs act (vic 1958) are usually indictable unless stated to be summary.
Offences in all other acts are summary offences unless stated otherwise

A
Heard by a judge and jury
Include offences stated in the crimes act and wrongs act unless stated otherwise.

Indictable offence heard summarily
A
Some offence that are indictable can be heard summarily in front of a magistrates
The criminal procedures act (2009) stated that crimes that are
- punishable by ten years or less
- or a 120k fine or less, may be heard summarily
A court must find it appropriate to do so
