What is a summary offence?
A summary offence, is a minor crime which is less serious in nature as compared to an indictable offence. A summary offence is listed in the Summary Offences Act Vic, and is heard in a magistrates court.
What is an indictable offence?
An indictable offence, is a crime which is serious in nature. And Indictable offence will be stated in the Crimes Act 1958 Vic. It will be heard in either a county or supreme court, but may be heard summarily in a magistrates court given that the right set of circumstances apply.
Indictable offence heard summarily
Indictable offences punishable by ten years or less in prison, or a fine that is 100,000 dollars or less may be heard summarily, if the accused agrees as according to the criminal procedures act.
