141.5 Requirements for a Pilot School Certificate

A

A. Completes an application on the form and in the manner prescribed by the FAA
B. Has held a provisional flight school certificate
C. Meets the applicable requirements under sub parts A-C of this part for the certificate and associated ratings sought.
D. Has established an 80% pass rate or higher on the first attempt for all:
1. Knowledge Tests leading to a certificate or rating
2. Practical Tests leading to a certificate or rating
3. End-of-course tests for an approved training course specified in Appendix K
4. End-of-course tests for special curricula courses approved under 141.57
E. Has graduated at least 10 different people from the schools approved training courses.

141.7 Provisional School Certificate

A

An applicant that meets the requirements of subparts A-C of pt 141 but lacks the recent training requirements of 141.5(d) may be issued a provisional pilot school certificate with ratings.

141.13 Application for issuance, amendment or renewal

A

A. Application for an original certificate and rating, an additional rating or renewal of a certificate under this part must be made on a form and in a manner prescribed by the FAA.

B. Application for the issuance or amendment of of a certificate or rating must be accompanied by two copies of each proposed training course curriculum for which approval is sought.

141.17 Duration of certificate and examining authority

A

A. Unless surrendered, suspended, or revoked and pilot school’s certificate expires:

 1. On the last day of  the 24th calendar month from the month the certificate was issued.
 2. Except as provided in paragraph (b) of this section, on the date that any change in ownership of the school occurs.
 3. On the date of any change in the facilities upon which the certificate is based occurs.
 4. Upon notice by the Administrator that the school has failed for more than 60 days to maintain the facilities, aircraft or personnel required for anyone of the schools approved training courses.

B. A change in ownership of a pilot school or provisional pilot school does not terminate that schools certificate if, within 30 days after the date of any change in ownership of the school occurs:

 1. Application is made for an appropriate amendment to the certificate; and
 2. No change in the facilities, personnel or approved training courses is involved

C. An examining authority issued to a holder of a pilot school certificate expiries on the date the school certificate expires, is surrendered, suspended or revoked.

141.18 Carriage of narcotic drugs, marijuana and depressant of stimulant drugs or substances

A

If the holder of a certificate issued under this part permits any aircraft owned or leased by that holder to be engaged in any operation that the certificate holder knows to be in violation of 91.19(a) of this chapter, that operation is a basis for suspending or revoking the certificate.

A

A. Pilot School Certificate must be displayed in an area normally accessible to the public and not obscured.

B. A certificate must be made available for view by:

 1. The administrator
 2. The NTSB
 3. Fed, State or Local LEO

141.21 Inspections

A

Each holder of a pt 141 certificate must allow the administrator to inspect the school to ensure that the school meets eligibility requirements of pt 141, 49 USC 40101 and the FARs

141.23 Advertising limitations

A

Can’t lie about being a 141 school

Must clearly state which courses are approved 141 courses

Advertising and signage must be removed from vacated premises or if the certificate is expired, revoked or suspended.

141.25 Business office and operations base

A

A. Need an office with a mailing address shown on your certificate

B. Facilities need to be adequate to operate as a school and keep required records

C. Principal business office cannot be shared with another flight school

D. FSDO must be notified at least 30 days prior to moving

E. Training can be conducted somewhere besides the primary business office provided it has been inspected by the administrator and the course of training has appropriate amendments added an approved to use that base

141.26 Training agreements

A

A. A Pt 142 approved training center may provide training, testing and checking for pt 141 schools provided

  1. A training agreement is in place between the center and school
  2. The training, testing and checking is done under pt 142
  3. The administrator approves the TCO for the training agreement
  4. The records of completed training, testing, checking are forwarded to the pt 141 school and kept as part of the students record

B. A pilot school that provides flight training for an institution of higher education that holds an LOA under 61.169 must have a training agreement with that institution of higher learning.

141.27 Renewal of certificates and ratings

A

A. Pilot School

  1. Renewal of a pilot school certificate can be applied for up to 30 days before the calendar month of expiration. The school must meet the requirements of (a)(2) of this section.
  2. The administrator must determine that the facilities, personnel, aircraft, airport, courses, records and recent training ability meet the requirements of pt 141.
  3. A school that does not meet (a)(2) may apply for a provisional certificate.

B. Provisional School Certificates cannot be renewed
-Schools can apply for a Pilot School Certificate provided they meet 141.5 or a new provisional certificate can be applied for after 180 days.
