A

No ‘Due Diligence’ Defence

Staff member of a newsagents sold a lottery ticket to a 13-year-old boy which was illegal. He believed he was over 16 years old and didn’t ask for proof of age.

The defendants were still guilty even though they had done their best to prevent this from happening in their shop.

D charged with selling intoxicating liquor to a drunken person. Apparently D did not know the person was drunk and there were no indications of intoxication either.

D was convicted, it was held that a sale had taken place and the person served was drunk.

It was an SL offence as it didn’t have to be proved that either D intended to outrage public decency, or that D was reckless as to whether his conduct would have the effect of outraging public decency.
