SECTION 1 OF POLICE AND CRIMINAL EVIDENCE ACT 1984
•police have the power to stop any person or vehicle in a public place
•reason to believe they are carrying illegal drugs, a weapon, stolen property or have something in their possession that might be used to commit a crime
REASONABLE GROUNDS OF SUSPICION – CODE OF PRACTICE A
•Under the codes of practise A, the police can only stop and search if they have reasonable grounds based on facts, information and intelligence
•person is unlawfully in possession or unlawfully obtained a prohibited article.
PROCEDURE/PROCESS (GOWISELY)
Ground– the police need reasonable grounds to S&S someone
Object – Police need to inform the person of the object/reason for S&S
Warrent – If in plain clothes, police need to provide warrant card
Identify – Identify themselves by name
State – State the police station they are attached too
Entitled – Explain they are entitled to record of search
Legal – Explain legal right which allows S&S (PACE 1984)
You – State “you are being detained for a search”
CONCLUDE WHETHER THIS WAS A LAWFUL STOP AND SEARCH BY THE OFFICERS
